Agreement
By accessing or using FreshMart’s website and services, you agree to these Terms of Service. If you do not agree, please do not use the site. We may update these terms; the latest version will always be posted here with an updated date.
Eligibility
You must be able to form a binding contract in your jurisdiction to place orders. If you use the site on behalf of a business, you represent that you have authority to bind that organization.
Products and pricing
We strive to display accurate descriptions, images, and prices for grocery items. Occasionally, errors may occur (including misprints or system glitches). We reserve the right to correct errors and to cancel or refuse orders that were placed based on incorrect information. Weights and cuts for fresh items may vary slightly; you will be charged based on the actual picked quantity where applicable.
Orders and payment
When you place an order, you offer to purchase the items in your cart subject to availability and these terms. We will confirm acceptance by email or in your account. Payment is due according to the method you select at checkout. Promotions, coupons, and member pricing are subject to their stated rules and dates.
Delivery and pickup
Delivery and pickup windows, fees, and minimum order amounts are shown at checkout and may vary by location. Someone of legal age must be available to receive orders containing restricted items where required by law.
Acceptable use
You agree not to misuse the site — for example, by attempting to disrupt our systems, scrape data without permission, or use the service for fraud. We may suspend or terminate access for violations.
Intellectual property
FreshMart branding, site design, and content (except where noted) are owned by us or our licensors. You may not copy or reuse them without permission.
Disclaimer
The site and services are provided “as is” to the fullest extent permitted by law. We disclaim warranties not expressly stated here, within limits allowed in your region.
Limitation of liability
To the extent permitted by law, FreshMart and its affiliates will not be liable for indirect, incidental, or consequential damages arising from your use of the site. Our total liability for any claim related to the services is limited to the amount you paid us for the order giving rise to the claim, or fifty dollars, whichever is greater, except where law does not allow such a cap.
Governing law
These terms are governed by the laws of the jurisdiction in which FreshMart operates its business, without regard to conflict-of-law rules. Courts in that jurisdiction will have exclusive venue unless otherwise required by consumer protection law in your country.
